C/Archive is a curated resale destination specializing in apparel, accessories, home goods, and lifestyle items — sourced from pre-owned inventory and new-with-tags pieces selected for their quality, provenance, and enduring relevance. C/Archive is owned and operated exclusively by Arch City Chic, Inc., an Ohio corporation.

These Terms of Service (these "Terms") govern all access to and use of the C/Archive website, platform, and related services (collectively, the "Site" or "Services"). Throughout these Terms, the words "we," "us," and "our" refer to Arch City Chic, Inc. The words "you" and "your" refer to the individual or entity accessing or using the Site.

Please read these Terms carefully before using the Site. These Terms constitute a legally binding agreement between you and Arch City Chic, Inc.

2.1   By accessing or using the Site in any manner — including browsing, creating an account, or completing a purchase — you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as any additional policies or guidelines incorporated by reference herein.

2.2   If you do not agree to these Terms in their entirety, you must immediately cease use of the Site and its Services.

2.3   Arch City Chic, Inc. reserves the right to revise, amend, or update these Terms at any time and at its sole discretion. Any changes will be effective upon posting the revised Terms to the Site. Your continued use of the Site following such posting constitutes your acceptance of the revised Terms.

2.4   We encourage you to review these Terms periodically to remain informed of any updates. The "Effective Date" at the top of this document reflects the date of the most recent revision.

3.1   Use of the Site is limited to individuals who are at least 18 years of age, or the applicable age of majority in their jurisdiction, whichever is greater.

3.2   By accessing or using the Site, you represent and warrant that you meet all applicable eligibility requirements and that you have the legal capacity to enter into a binding agreement.

3.3   Arch City Chic, Inc. reserves the right to refuse access to or use of the Site to any person or entity, at any time, for any reason, at its sole and absolute discretion.

3.1   Use of the Site is limited to individuals who are at least 18 years of age, or the applicable age of majority in their jurisdiction, whichever is greater.

3.2   By accessing or using the Site, you represent and warrant that you meet all applicable eligibility requirements and that you have the legal capacity to enter into a binding agreement.

3.3   Arch City Chic, Inc. reserves the right to refuse access to or use of the Site to any person or entity, at any time, for any reason, at its sole and absolute discretion.4.1   C/Archive's inventory consists of pre-owned and new-with-tags items across categories including apparel, accessories, home goods, and lifestyle items. Each item is individually sourced and reviewed prior to listing.

4.2   Arch City Chic, Inc. makes reasonable efforts to describe item condition accurately. Condition designations — such as Excellent, Good, and Fair — are applied in good faith based on internal review. However, we do not warrant that all descriptions are entirely free of error.

4.3   Product photography is produced under controlled conditions; colors, textures, and tones may appear differently on individual screens and display devices. Minor variations between photographs and physical items are inherent to the nature of digital imagery and shall not constitute grounds for return or refund.

4.4   All items are offered in the condition as described at the time of listing. By completing a purchase, the buyer acknowledges and accepts the item's disclosed condition.

5.1   All prices displayed on the Site are listed in United States dollars (USD) and are subject to change without prior notice.

5.2   Arch City Chic, Inc. reserves the right to correct pricing errors at any time. In the event that an item is listed at an incorrect price — whether due to typographical error, system error, or any other cause — Arch City Chic, Inc. reserves the right to cancel or refuse the order at the mispriced amount and issue a full refund to the buyer.

5.3   All inventory is subject to availability. The display of an item on the Site does not constitute a guarantee that the item is available for purchase or that the transaction will be completed.

5.4   Applicable sales taxes will be calculated and applied at checkout in accordance with the laws of the State of Ohio and any other applicable state or local tax requirements based on the buyer's shipping address.

6.1   C/Archive accepts payment through the following methods:

(a) Credit and debit cards, processed securely through Stripe;

(b) PayPal; and

(b) Google Pay at checkout.

Additional payment methods may be introduced at Arch City Chic, Inc.'s discretion and will be reflected on the Site at time of checkout.

6.2   Payment is due in full at the time of purchase. Orders will not be processed or fulfilled until payment is confirmed.

6.3   Arch City Chic, Inc. does not store full payment card information on its servers. All card transactions are processed by PCI-DSS compliant third-party payment providers. By submitting payment, you authorize the applicable provider to process your transaction.

6.4   You agree to provide accurate, current, and complete payment information. You further represent that you are authorized to use the payment method submitted.

6.5   Arch City Chic, Inc. reserves the right to cancel any order it reasonably suspects to be fraudulent, unauthorized, or in violation of these Terms, without prior notice and without liability.

7.1   All orders ship from Ohio. Estimated delivery timelines are provided at checkout as a courtesy and are not guaranteed. Actual delivery times may vary based on carrier, destination, and other factors beyond our control.

7.2   Risk of loss and title to purchased items pass to the buyer upon delivery of the item to the designated carrier. Arch City Chic, Inc. is not responsible for loss, theft, or damage that occurs after transfer to the carrier.

7.3   Arch City Chic, Inc. shall not be liable for shipping delays caused by carrier operations, inclement weather, natural events, customs processing, government action, or any other circumstances outside of our reasonable control.

7.4   International shipping may be offered at Arch City Chic, Inc.'s discretion. For international orders, the buyer is solely responsible for all applicable duties, import taxes, customs fees, and any regulatory requirements imposed by the destination country.

7.5   It is the buyer's responsibility to verify the accuracy of the shipping address provided at checkout. Arch City Chic, Inc. is not responsible for orders that are lost, delayed, or undeliverable due to an incorrect or incomplete address submitted by the buyer.

All Sales Are Final Unless Otherwise Expressly Stated. Most items sold through C/Archive are designated Final Sale and are not eligible for return, exchange, or refund.

8.1   The Final Sale designation will be clearly indicated on applicable product listings at the time of purchase. By completing a purchase of a Final Sale item, you acknowledge and accept this policy without exception.

8.2   Exceptions. A return or refund may be considered only under the following limited circumstances:

(a) The item received is materially different from its listing description; or

(b) The item arrives damaged due to circumstances occurring during transit.

To initiate a return under these exceptions, the buyer must contact Arch City Chic, Inc. within [48] hours of confirmed delivery, providing written notice and photographic documentation substantiating the claim.

8.3   Approved returns must be shipped back to Arch City Chic, Inc. within [7] days of written return authorization. Items returned without prior authorization will not be accepted.

8.4   Arch City Chic, Inc. reserves the right to assess, evaluate, and determine eligibility for returns at its sole and absolute discretion. Submission of a return request does not guarantee approval.

8.5   Refunds that are approved will be issued to the original payment method used at the time of purchase. Processing times may vary depending on the payment provider.

All Sales Are Final Unless Otherwise Expressly Stated. Most items sold through C/Archive are designated Final Sale and are not eligible for return, exchange, or refund.9.1   All content appearing on the C/Archive Site — including but not limited to text, product photography, graphics, logos, visual design, and editorial content — is the exclusive property of Arch City Chic, Inc. or is used under license, and is protected by applicable copyright, trademark, and intellectual property laws.

9.2   The names "C/Archive" and "Arch City Chic", and all associated branding, are identifiers proprietary to Arch City Chic, Inc. Unauthorized use of these marks — in any form or medium — is strictly prohibited.

9.3   You may not reproduce, distribute, republish, modify, adapt, transmit, display, or use any Site content for commercial purposes without the prior express written consent of Arch City Chic, Inc. Any authorized use must comply with any conditions set forth in writing by Arch City Chic, Inc.

10.1   C/Archive may offer the ability to create a user account to facilitate purchases, order tracking, and related services. Account creation and use are subject to these Terms.

10.2   You are solely responsible for maintaining the confidentiality of your account credentials, including your username and password. You agree not to share your credentials with any third party.

10.3   You are responsible for all activity that occurs under your account, whether or not authorized by you. Arch City Chic, Inc. shall not be liable for any loss or damage arising from unauthorized account access resulting from your failure to safeguard your credentials.

10.4   If you suspect any unauthorized access to or use of your account, you must notify Arch City Chic, Inc. immediately at the contact information provided in Section 18.

10.5   Arch City Chic, Inc. reserves the right to suspend, deactivate, or permanently terminate any account that violates these Terms, engages in prohibited conduct, or poses a risk to the integrity of the Site or its users.

By using the Site, you agree that you will not, under any circumstances:

11.1   Use the Site for any unlawful purpose or in violation of any applicable local, state, national, or international law or regulation;

11.2   Submit false, misleading, or fraudulent information in connection with any purchase, account registration, or communication with Arch City Chic, Inc.;

11.3   Engage in or facilitate any fraudulent transactions, chargebacks, or payment disputes in bad faith;

11.4   Attempt to gain unauthorized access to the Site, its servers, databases, or any connected systems or networks;

11.5   Use automated tools, bots, scrapers, crawlers, or similar means to collect, harvest, or copy content from the Site without express written permission;

11.6   Interfere with, disrupt, or degrade the operation, security, or integrity of the Site or its infrastructure;

11.7   Resell or commercially exploit items purchased through C/Archive without express prior written authorization from Arch City Chic, Inc.; or

11.8   Impersonate Arch City Chic, Inc., C/Archive, or any employee, agent, or representative thereof in any context.

12.1   Your use of the C/Archive Site is also governed by our Privacy Policy, which is incorporated into these Terms by reference in its entirety. In the event of any conflict between these Terms and the Privacy Policy with respect to privacy-related matters, the Privacy Policy shall control.

12.2   By accessing or using the Site, you acknowledge and consent to the collection, use, and disclosure of your information as described in the Privacy Policy.

13.1   THE SITE AND ALL OF ITS CONTENT, PRODUCTS, AND SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT.

13.2   Arch City Chic, Inc. does not warrant or represent that the Site will be continuously available, uninterrupted, timely, secure, or error-free, or that defects will be corrected. We do not warrant that the Site is free of viruses, malware, or other harmful components.

13.3   Pre-owned items are sold in the condition described at the time of listing. No warranty of merchantability or fitness for a particular purpose is extended with respect to any item beyond what is expressly and specifically stated in the applicable product listing.

14.1   TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, ARCH CITY CHIC, INC., ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES OF ANY KIND ARISING OUT OF OR RELATED TO: (A) YOUR USE OF OR INABILITY TO USE THE SITE; (B) ANY PURCHASE OR TRANSACTION MADE THROUGH THE SITE; OR (C) ANY UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR DATA OR ACCOUNT.

14.2   In no event shall the total aggregate liability of Arch City Chic, Inc. to any buyer, for any claim arising out of or related to a specific transaction, exceed the total amount paid by the buyer for the specific item or order giving rise to that claim.

14.3   Some jurisdictions do not permit the exclusion or limitation of certain categories of damages. In such jurisdictions, the limitations and exclusions set forth in this Section shall apply only to the maximum extent permitted by applicable law.

15.2   Arch City Chic, Inc. reserves the right to assume exclusive control of the defense of any matter subject to indemnification by you, at your expense. You agree to cooperate fully with Arch City Chic, Inc. in asserting available defenses.

16.1   These Terms and any dispute arising out of or related to them or the Site shall be governed by and construed in accordance with the laws of the State of Ohio, without giving effect to any choice of law or conflict of law rules or provisions.

16.2   Any legal action or proceeding arising under or relating to these Terms shall be brought exclusively in the state or federal courts of competent jurisdiction located in Franklin County, Ohio. You irrevocably consent to the personal jurisdiction and venue of such courts.

16.3   Before initiating any formal legal proceeding, Arch City Chic, Inc. encourages you to contact us directly to seek an informal resolution. Many concerns can be resolved efficiently and respectfully without litigation. Please refer to Section 18 for contact information.

17.1   Arch City Chic, Inc. may revise these Terms at any time by posting an updated version to the Site. The revised Terms will be identified by a new Effective Date.

17.2   Revised Terms are effective immediately upon posting. Your continued use of the Site following the posting of updated Terms constitutes your acceptance of those changes.

17.3   For changes that Arch City Chic, Inc. determines to be material in nature, we will endeavor to communicate such changes in a manner reasonably designed to bring them to your attention — which may include prominent notice on the Site or direct communication to registered account holders. However, it remains your responsibility to review these Terms periodically.
